PUWER, or the Provision and Use of Work Equipment Regulations 1998, set out what employers must do to safeguard workers using equipment in the workplace. The regulations cover everything from CNC machines to forklifts. PUWER stipulates an employer’s duty to ensure equipment is: suitable for use, properly maintained and regularly inspected.
There are too many examples of where a breach in PUWER has led to serious injury or even a fatality of an employee, often in these instances safety measures have been overlooked by either operators or management teams. Inadequate guarding and emergency stop devices are all too common in the work place, whether this is a genuine oversight or safety requirements being purposely ignored the outcome is the same. You could face serious impact on your business by not following legislation and showing due diligence. Prohibition notices, prosecution or even custodial sentences are issued by the regulating body (HSE) where employers are found to be in breach of the PUWER regulations.
